In these Terms and Conditions:
‘we’, ‘us’ or ‘our’ means Simply Thai UK Ltd trading as simplythaibuxton
‘you’, ‘your’ means the person or party using the Website
‘simplythaibuxton website’ means simplythaibuxton.co.uk as operated by us
‘working day’ means any day other than a Saturday, Sunday and a bank holiday in England and Wales.
By using the www.simplythaibuxton.co.uk and/or placing an order with us you are deemed to accept these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not use register form or use the simplythaibuxton website.
You must be 18 years old or above to register with simplythaibuxton website. In order for us to be able to fulfill orders to you, we require you to register with our website. It is your responsibility to ensure that the personal information that we hold on you is accurate and up-to-date. You can change your account details along with subscription to our email newsletter in the account area of the simplythaibuxton website at any time.
www.simplythaibuxton.co.uk reserves the right to suspend or cancel any registration at any time whether or not any breach of these Terms and Conditions has occurred.
You can pay via any Credit or Debit card through PayPal.
We do not accept payment by cash or cheque.
Shipping costs are calculated prior to checkout based on weight of the items in your cart and the location of your delivery address.
Delivery time: 3 working week days after the day of dispatch should be considered for guidance only (as delivery times are not guaranteed by the couriers), and not forming any part of a guarantee.
Once we have received your order, we aim to process and dispatch it within 3 working days; usually much faster! subject to having received payment of the goods.
Simply Thai UK Ltd accepts no responsibility for loss or inconvenience caused as a result of delays in deliveries by us or our suppliers and are unable to refund delivery charges in cases of late/ delayed delivery. Orders cancelled or deliveries refused due to late/delayed delivery will be treated as described in the Cancellation/Returns paragraphs below.
All products are sent by courier of our choice and, upon delivery of the goods, the purchaser of the goods becomes responsible for any losses or damages arising as a result of their use however they may arise.
Goods will be delivered to the address specified by you on the online check-out form. We reserve the right to charge for any extra carriage costs incurred should the incomplete or inaccurate address by entered on your order. Until dispatch of your order please contact us to amend or add any delivery details. www.simplythaibuxton.co.uk and our couriers can only be responsible for delivery to addresses in the UK registered with Royal Mail. Delivery cannot be guaranteed to any addresses inputted which are not registered with Royal Mail. If a delivery address is difficult to locate, extra directions should be included in the Delivery Instructions box during Checkout.
Confirmation of dispatch and tracking details will be sent by email or text message to the recipient of the parcel, and the recipient should monitor the tracking information supplied on the courier's website and advise us if goods have still not been delivered 24 hours after the stated delivery time in the message. It is the recipient's responsibility to ensure that the parcel can be received or left in a safe location. www.simplythaibuxton.co.uk will not be liable for damage to, or deterioration of goods caused by unsuccessful delivery attempts by couriers. Packages returned to us by couriers after unsuccessful delivery attempts will be refunded minus the cost of shipping.
During periods of extreme weather (snow, flooding etc.), deliveries are likely to be (in some cases, severely) delayed. Delays may continue after weather conditions have returned to normal, due to backlogs at couriers' depots.
You acknowledge that by visiting the website from time to time, you shall become bound to the current version of the relevant terms and conditions (the "current version") and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the website.
Although Simply Thai UK Ltd strives to offer you the best service possible, Simply Thai UK Ltd makes no promise that the services at www.simplythaibuxton.co.uk will meet your requirements. Simply Thai UK Ltd cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it via email to firstname.lastname@example.org and we will correct the fault as soon as we reasonably can.
In order to provide you with the best service possible, we will sometimes need to take the simplythaibuxton website down for maintenance and repairs. During this time you will not be able to use this service, however rest assured we will be doing all we can to bring this service back up as soon as reasonably possible.

In particular, neither www.simplythaibuxton.co.uk nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof.

Any relevant terms and conditions, policies and notices shall be governed by and construed in accordance with the laws of Great Britain without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of the High Court of Great Britain in respect of any disputes arising in connection with the website, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith.
Pricing and Product Availability
The prices of shown on the simplythaibuxton website are inclusive of VAT but exclusive of delivery charge.
Pricing and product availability are subjected to change without notice.
If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you.
Although we make the utmost effort to ensure complete accuracy when assembling your order, mistakes do occasionally happen. Should we mistakenly dispatch products which are completely different to those ordered, we will either offer a partial refund on the item(s) or, should that be unacceptable, will ask you to return the item(s) to us by the most economical method and, upon receipt in a sealed, original, complete, undamaged packaging and fully resalable condition, we will make a full refund of both the original purchase price and the return postage cost to your payment card. We make no guarantee that we will be able to resend the original item ordered, this decision will be taken by in each case by Management and will be final.
Please note that we aim to dispatch your order within two working days of receipt. We may be able make alterations to your order only up to the point of dispatch.
Although we will always try to cater for your orders, an order of large quantities of a particular line or of items which are in bulky or fragile (e.g., glass) packaging can only be fulfilled at our discretion. We may therefore decide to omit some items in order to avoid the risk of either excess courier charges for oversized parcels, or the occurrence of in-transit breakage of a large number of glass items.
Simply Thai gift vouchers can be used to purchase goods, food and drink at Simply Thai Restaurant, Buxton only not for online shopping. The full value of the voucher must be used within one transaction; no balance can be retained on the gift voucher. Change in the form of currency or credits to credit or debit cards cannot be provided. Gift vouchers cannot be exchanged for cash. Vouchers are non-refundable. Gift vouchers have a 12 month validity; they will expire one year from the date stated.
A purchase contract for us to supply you with products is only created when the order is dispatched and it is only then that you are charged for your order. Until the point of dispatch, we have not accepted the order and are not obligated to supply these goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and us.
www.simplythaibuxton.co.uk is intended to be available for non-commercial and domestic use only. Whilst we guarantee that all items supplied will be fit for consumption upon delivery, Simply Thai UK Ltd accepts absolutely no responsibility for items which the recipient deems unsuitable for resale (for example, cosmetic damage to packaging or a Best Before date considered too short).
Acceptance of Orders
When the courier arrives, the customer should check all contents before signing for it. You should inspect any products immediately upon receipt and you will be deemed to have accepted the products unless, during the period which commences on the day the contract between us comes into existence and ends on the expiry of seven working days beginning on the day after delivery of the products, you notify us, in accordance with the provisions of the Cancellation paragraph below, that the products are rejected or that you wish to cancel. If no such action is taken, we will consider the products being as described, of satisfactory quality and fit for their purposes, and may not accept any rejection or cancellation at a later date.
If you do not receive goods ordered by you within 21 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address or email us at email@example.com of the problem within 30 days of the date on which you ordered the goods.
All Goods are photo recorded to ensure a correct packing process. Any shortages, errors, damage or breakages MUST be reported within 24 hours. Reports of errors, damage or breakage must be accompanied by photographic evidence (one image per product) and emailed to firstname.lastname@example.org in the same day. Your statutory customer rights are not affected.
If you wish to cancel your order, please contact us at email@example.com or by telephone on 01298 24471 between 10.30am and 5pm Monday to Friday. If we receive notice of your cancellation in time, prior to despatch, we will cancel the order and we will refund you on the expiry of seven working days beginning on the day after the date of delivery of the products. Please note that standard cancellation conditions will apply regardless of the reason for cancellation - this includes packages rejected at the time of delivery. Upon return of the goods to us, a refund of the purchase price and original shipping charges will be made to the original payment card, less a Return Delivery Charge (see Returns below) if applicable, within seven days.
Returns and Refunds
All items being returned to us via your local Post Office or your own courier will be at your own expense unless faulty or sent in error. In such circumstances we will accept any returned, all products must be sealed, in original, complete and undamaged packaging. If the item has not been returned to us in fully resalable condition, we reserve the right to refuse a refund on the item unless faulty or defective. Please make sure you contact us before returning/rejecting any item. Any item returned without our knowledge may not be refunded and may be subject to a Return Delivery Charge.
For goods not yet delivered, or for goods to be rejected at the time of delivery you will contact us by telephone or email at the address or number (as the case may be), set out in the Contact Us section of this site, with details of your original order number. Refunds for goods returned in these circumstances will be subject to the cost of the Return Delivery Charge.
Please note that the items remain your property until we have received them. You are therefore responsible for your goods while they are in transit to us. For your own protection we recommend using a secure recorded delivery method. You are responsible for all return delivery charges. Upon receipt of non-perishable goods in a resalable condition, a full refund of the purchase price and the original delivery charge will be credited to your credit/debit card.
Faulty/damaged products which are to be returned must be returned before the refund can be issued. When the return arrives back at our office it will be assessed, should it be concluded that the products are faulty/unfit for consumption, the return delivery charge and purchase cost will be refunded.
We strongly advise that you use a recorded delivery service. If a recorded delivery service is not used and the goods do not reach us, we cannot be held responsible for the cost of the goods. Refunds can be in the form of a credit or made to the card used for payment.
